Infuriated by the district court’s decision, Brown took its appeal all the way to the Supreme Court and along the way got an outpouring of support from other schools. More than forty individual colleges and university systems along with seventeen educational associations and sport-governing bodies submitted amici briefs. Even the American Council on Education, which represents 1,800 colleges and universities around the country, was against a small group of female student-athletes requesting equity, Ellen Staurowsky reported in a long analysis of Title IX and gender equity published in Journal of Sport and Social Issues. As the Brown Daily Herald, which was in favor of the plaintiffs, reported: “With the court’s finding that Brown—among the nation’s leaders in athletic offerings for female students—is violating Title IX, institutions nationwide with less impressive records regarding women’s athletics will likely be forced to radically improve their offerings.” Cohen v. Brown, the editors predicted, would probably become a benchmark “with repercussions throughout the world of higher education.”
